The terms of service of our website, hereinafter called Terms of Service or simply Terms, include the terms of this document as well as those of:

• Privacy Policy
• Payment Conditions of the brokerage commission

Acceptance of our terms of service is understood as including the clauses set forth in these three documents.

Service Description

The website La Fábrica Patronato, hereinafter referred to as The Website, and the services operated therein are the property of Inmobiliaria Dagorret Ltda., hereinafter called The Company. The main purposes of the website are:

• to inform about the commercial premises located on Patronato street that the company leases (features description, calendar of availability, etc);
• to promote the same in the real estate market.

As a promotion mean, the company runs an «online brokerage» service, hereinafter called The Service, which is available from the RECOMMEND page and whose main purpose is to encourage the users of the website to recommend the company's comercial premises to potential customers. When a premise is leased through the recommendation service, a commission is paid to the author of the recommendation.

Inmobiliaria Dagorret Ltda. reserves the right to stop running the service at any time and without prior notice, but recommendations submitted prior to the interruption will keep their rights to be retributed according to the conditions in force at submission time.

Conditions to Use the Recommendation Service

The service can be used by any natural person of legal age, holder of a valid Chilean RUT, and who is not a professional in the real estate sector.

The recommendations that a user can send are limited to 10, but in practice up to 4 additional recommendations are allowed depending on the user's remaining credit at the time of starting their last posting session. Up to 5 recommendations can be sent in each session.

Personal Data

The processing of personal data by our system is exlained thoroughly in the page devoted to our Privacy Policy and to the use of cookies.

In relation to the execution of this recommendation service, it should be noted that:

• the user is informed of the collection and processing of their personal data for the execution of the service;
• the user agrees to communicate any changes to their data, particularly their contact data, in order for us to be able to locate them should the brokerage commision be paid;

Furthermore, it is expressly established here that by accepting the terms of this service, the user confirms to waive charging the brokerage commission that he or she could claim in case of exercising, according to the law, your right to delete your data from our system.

It is understood that when deleting the personal data of a user in response to their request, the company will no more be able to check the legitimacy of a subsequent payment request.

Practical Details

The proof of a recommendation consists of a receipt that is delivered to the user by email, and which contains the following information:

• the identity of the person sending the recommendation;
• the identity of the recipients of the recommendations;
• the date, time and sending status of the recommendation;

The receipt carries a bar code with information encrypted using two secret keys, one belonging to the service and the other to the user. This allows checking both the authenticity and the ownership of the receipt, that is, on the one hand that it was generated by our server, and on the other hand that it is due to the action of it's holder.

Limitations

Only the recommendations sent through this service are taken into account, when successfully sent and duly authenticated by your receipt. Failed shipments are expressly excluded as well as any other type of contact that may have existed between the recommending user and the entity receiving the recommendation.

Likewise, it is expressly established that the recommendations sent to email addresses belonging to domain administrators listed in the NIC records will not be taken into account. This in order not to encourage abusive spamming campaigns.
